Welcome to Sriya Digital Solutions (a unit of Dot Technologies, Estd. 2009). These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "User", "You") and Sriya Digital Solutions ("Company", "We", "Us", "Our") governing your use of our digital marketing services, website, and any related interactions. By using our services, you agree to comply with these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the services after any changes constitutes acceptance of the new Terms.

Sriya Digital Solutions offers a range of digital marketing services including but not limited to:
- Bulk SMS Marketing
- WhatsApp Business API Marketing
- RCS Messaging
- IVR & Toll-Free Services
- Social Media Marketing
- Search Engine Optimization (SEO)
- Web Development & Design
All services are provided on a best-effort basis. We reserve the right to modify, suspend, or discontinue any service at any time with or without notice.
3. User Accounts & Registration
To access certain services, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and update your information to keep it accurate.
- Be solely responsible for the activity that occurs on your account.
- Keep your login credentials confidential and notify us immediately of any unauthorized use.
- Accept liability for all actions taken under your account.
4. Payment Terms & Razorpay Compliance
All payments for our services are processed through Razorpay, a PCI-DSS compliant payment gateway. By using our services, you agree to the following payment terms:
- Payment Processing: All transactions are processed through Razorpay. We do not store any credit/debit card details, CVV, or sensitive payment information on our servers.
- Billing: Services are billed on a prepaid or subscription basis as agreed. Invoices are generated and sent via email.
- Refund Policy: All purchases are final and non-refundable unless otherwise stated in a separate agreement. Credits purchased for SMS/WhatsApp services are non-refundable and must be used within the validity period.
- Payment Disputes: Any disputes regarding payments must be raised within 7 days of the transaction date. You agree to cooperate with us and Razorpay in resolving any payment issues.
- Taxes: All prices are exclusive of applicable taxes (GST, etc.) unless stated otherwise. You are responsible for any taxes applicable to your jurisdiction.
Secure Payments via Razorpay
We use Razorpay as our payment partner. All transactions are encrypted and processed in compliance with RBI guidelines. Your payment data is handled securely, and we do not store your financial information.
5. Service Usage & Acceptable Use Policy
You agree to use our services in compliance with all applicable laws and regulations. Specifically, you agree NOT to:
- Send unsolicited messages (spam) or use our services for any illegal purpose.
- Transmit content that is defamatory, obscene, harassing, threatening, or discriminatory.
- Violate any intellectual property rights, including copyrights, trademarks, or patents.
- Use our services to send messages promoting alcohol, gambling, dating, or any content that violates TRAI guidelines.
- Engage in any activity that could harm, disable, or impair our network or services.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use our services to harvest or collect personal information of others without consent.
We reserve the right to suspend or terminate your account immediately if we suspect any violation of these usage policies.
6. Content Responsibility
You are solely responsible for the content of all messages, campaigns, and materials transmitted through our services. You represent and warrant that:
- You have obtained all necessary consents from recipients to send messages.
- Your content does not violate any applicable laws, regulations, or third-party rights.
- You will indemnify and hold us harmless from any claims arising from your content.
We reserve the right to review, remove, or reject any content that we deem inappropriate or in violation of these Terms.
7. Delivery, Performance & Limitations
While we strive to ensure reliable delivery of SMS, WhatsApp, and other messages, we cannot guarantee 100% delivery due to factors beyond our control:
- Network congestion, operator outages, or technical failures.
- Recipient device availability, memory, or network coverage.
- Regulatory restrictions or compliance requirements.
- Delivery times may vary and are estimates, not guarantees.
We are not liable for any loss, damage, or inconvenience caused by message delivery failures or delays.
8. Credit & Refund Policy
Our services operate on a prepaid credit system:
- Credits purchased for SMS, WhatsApp, or other services are non-refundable.
- Credits must be used within the validity period specified at the time of purchase.
- No carry-forward of unused credits will be allowed unless otherwise agreed in writing.
- We do not provide refunds for undelivered messages as delivery is subject to network conditions.
9. Intellectual Property
All content, trademarks, logos, software, and materials on our website and services are the property of Sriya Digital Solutions or its licensors. You may not:
- Copy, modify, reproduce, or distribute any part of our services without written permission.
- Use our trademarks, logos, or brand assets without explicit consent.
- Reverse engineer, decompile, or disassemble any part of our software or systems.
10. Limitation of Liability
To the maximum extent permitted by law, Sriya Digital Solutions and its affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or business opportunities.
- Damages arising from service interruptions, message delivery failures, or network issues.
- Any unauthorized access to or use of our servers or your data.
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.
Limitation of Liability
Our services are provided "as is" and "as available". We do not warrant that the services will be uninterrupted, error-free, or meet your specific requirements. You use our services at your own risk.
11. Indemnification
You agree to indemnify, defend, and hold harmless Sriya Digital Solutions, its directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Your use of our services in violation of these Terms.
- Your content, messages, or campaigns transmitted through our services.
- Your breach of any applicable laws or regulations.
- Any dispute between you and third parties arising from your use of our services.
12. Termination
We may terminate or suspend your account and access to our services at any time, with or without cause, with or without notice, including but not limited to:
- Violation of these Terms or our policies.
- Suspected fraudulent or illegal activity.
- Non-payment of fees or dues.
- At our sole discretion, to protect our services or other users.
Upon termination, any unused credits in your account will be forfeited and not refunded.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Durgapur, West Bengal, India. You agree to first attempt to resolve any dispute through informal negotiations before pursuing formal legal action.
14. Data Protection & Privacy
We respect your privacy and handle your personal data in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and processing of your data as described in our Privacy Policy. We comply with the Information Technology (Reasonable Security Practices) Rules, 2011, and the proposed Digital Personal Data Protection Act, 2023.
15. Changes to Terms
We reserve the right to update, modify, or change these Terms at any time. We will notify you of significant changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
